Realistically, how often are domains traded and suddenly put in legitimate use (that isn't some domain parking scam) that (1) and (2) are actual arguments? Lol
Domain trading (regardless if the previous use was legitimate or not) is only one example, not the sole driving argument for why the revocation system is in place or isn't perfectly handled.
