). Oops, I thought it was so obviously going to be done away with in the courts, but in 1912 the Supreme Court ruled that it applies only to criminal punishments.

The Supreme Court’s standing doctrine is also weird. If the board of directors approves it, then would the shareholders even be able to sue?
